This Privacy Policy describes how we collect, use, disclose, and safeguard your information when you visit our Website. It is our policy to respect your privacy and comply with any applicable law and regulation regarding any personal information we may collect about you. Please read this Privacy Policy carefully. If you do not agree with the terms of this Privacy Policy, please do not access the site.

We reserve the right to make changes to this Privacy Policy at any time and for any reason. We will alert you about any changes by updating the "Last Updated" date of this Privacy Policy.

2. What Information We Collect

In the last twelve (12) months, we have collected the following categories of personal information :

A. Information You Voluntarily Provide to Us We collect personal information that you voluntarily provide to us when you register on the Website, express an interest in obtaining information about us or our products, make a purchase, or otherwise contact us. This information may include:

B. Information Collected Automatically When you access our Website, we may automatically collect certain information about your device and usage. This information may include:

  • Internet or Other Electronic Network Activity Information: This includes your IP address, browser type, operating system, referring URLs, pages viewed, and dates/times of access.

  • Cookies and Tracking Technologies: We use cookies and similar tracking technologies to access or store information to enhance your experience on our site. You can control the use of cookies at the individual browser level, but if you choose to disable cookies, it may limit your use of certain features or functions on our Website.

C. Sensitive Personal Information We may collect the following categories of sensitive personal information:

  • Account log-in and password or other credentials allowing access to your account.

3. How We Use Your Information

We use the personal information we collect for a variety of business purposes, including to :

  • Fulfill our contract with you: To process your transactions, manage your orders, and deliver the digital products you have purchased.

  • Manage your account: To create and manage your account with us and provide customer support.

  • Communicate with you: To send you administrative information, such as updates to our terms, conditions, and policies, and to respond to your inquiries.

  • Marketing purposes: To send you promotional communications about new products, special offers, or other information we think you may find interesting, provided you have consented to receive such communications.

  • Improve our Services: To analyze usage and trends to improve our Website and your user experience.

  • Protect our Services: To keep our Website safe and secure, including fraud monitoring and prevention.

  • Comply with legal obligations: To comply with applicable laws and regulations.

4. How We Share Your Information

We may share your information with third parties in the following situations :

  • With Service Providers: We may share your information with third-party vendors, service providers, contractors, or agents who perform services for us or on our behalf and require access to such information to do that work. Examples include payment processing (Square), website hosting (Wix), and analytics providers (Google Analytics).

  • For Marketing and Advertising: We may share your information with advertising partners to show you ads on other websites (this is known as "cross-context behavioral advertising"). Under California law, this may be considered "sharing" your personal information.

  • By Law or to Protect Rights: We may disclose your information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process.

  • Business Transfers: We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

We do not "sell" personal information in the traditional sense of the word. However, because the definition of "sale" under the CCPA is broad, it may include our sharing of data for advertising purposes.

5. Data Retention

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Policy, unless a longer retention period is required or permitted by law. The criteria used to determine our retention periods include the length of time we have an ongoing relationship with you and whether there is a legal obligation to which we are subject.

6. Your California Privacy Rights (CCPA/CPRA)

If you are a resident of California, you are granted specific rights regarding your personal information under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA). This section describes your rights and explains how to exercise them.

  • The Right to Know and Access: You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months.

  • The Right to Delete: You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions.

  • The Right to Correct: You have the right to request that we correct any inaccurate personal information that we maintain about you.

  • The Right to Opt-Out of Sale or Sharing: You have the right to direct us not to "sell" or "share" your personal information at any time. We are required to provide a clear and conspicuous link on our website titled "Do Not Sell or Share My Personal Information" that enables you to exercise this right.

  • The Right to Limit Use of Sensitive Personal Information: You have the right to direct us to limit our use of your sensitive personal information to that which is necessary to perform the services or provide the goods reasonably expected. We are required to provide a clear link on our website titled "Limit the Use of My Sensitive Personal Information" to allow you to exercise this right.

  • The Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA rights. We will not deny you goods or services, charge you different prices, or provide you a different level or quality of goods or services.

How to Exercise Your Rights: To exercise the rights described above, please submit a verifiable consumer request to us by emailing us at: nai@thenaiproject.com

As we operate exclusively online, you may use this email address to submit your requests. We will respond to your request within the timeframes required by law.

7. California's "Shine the Light" Law

California Civil Code Section 1798.83, also known as the "Shine the Light" law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below.

8. "Do Not Track" Policy (CalOPPA)

The California Online Privacy Protection Act (CalOPPA) requires us to disclose how we respond to "Do Not Track" (DNT) signals. Some web browsers incorporate a DNT feature. Because there is not yet a common understanding of how to interpret DNT signals, our Website does not currently respond to DNT browser signals or mechanisms. However, you can exercise your right to opt-out of the sale or sharing of your personal information through the methods described in Section 6.

9. Children's Privacy

Our Services are not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. Under the CCPA, we do not knowingly sell or share the personal information of consumers under 16 years of age unless we receive affirmative authorization ("opt-in") from either the consumer who is between 13 and 16 years of age, or the parent or guardian of a consumer less than 13 years of age. If you become aware that a child has provided us with personal information in violation of this Policy, please contact us.

10. Data Security

We have implemented commercially reasonable administrative, technical, and physical security measures designed to protect the security of any personal information we process. We use technologies like Secure Sockets Layer (SSL) to encrypt sensitive information. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure.
